Mediation

Overview of Divorce Mediation

A Popular Form of Alternative Dispute Resolution

At Mancini & Associates, LLC, we are here to assist individuals with every aspect of the divorce process. We are well-aware that divorce can be a very stressful and emotionally trying time for all involved. In some cases, especially when there are unresolved differences, divorcing couples benefit dramatically by going through mediation, a very popular form of alternative dispute resolution (ADR).

Our Hartford divorce lawyers strive to inform you of your rights in the divorce process, to make things go as smoothly and efficiently as possible, and to give you the tools you need to reach an amicable and fair divorce settlement. One way we accomplish these goals, is through divorce mediation.

Why Consider Mediation?

Most people would agree that divorce does not come easily, at least not for the average person. While some divorces are easier than others when there are no children or assets involved, once you enter children, real estate, and other assets into the equation, the stakes automatically get higher.

It is very common for couples to have some disagreements over major issues such as who gets the kids, or who gets the house, but no matter how big these issues are, most people would much rather resolve their own differences, instead of having a judge decide for them. This is where mediation comes in.

Reasons to consider mediation:

  • You and your spouse maintain control over your divorce.
  • Mediation is much more affordable than a full-blown court battle.
  • Mediation is confidential.
  • You can still use your lawyer for legal advice.
  • The mediation process can improve communication between you and your spouse.

How Mediation Works

With mediation, you and your spouse will sit down with a neutral third-party (the mediator), who will help you and your spouse negotiate a fair agreement over issues regarding: child custody, visitation, alimony, and property and debt division.

Since negotiating a settlement agreement is not always linear, the mediator will help you and your spouse stay on track and brainstorm various options. The best way to succeed in mediation is to be open to compromise, and to try and understand your spouse's point of view.

Contact a Hartford Divorce Lawyer Today

Once mediations are complete, the mediator or one of your attorneys will draft an agreement, which should include a parenting plan (if you have children). It is best to have your attorney's input and involvement during the process, this way you can ensure that your legal rights are fully protected.

If you are interested in exploring the possibility of mediation, contact our firm to set up a confidential case evaluation with one of our divorce attorneys. We would be more than glad to explain your legal options so you can choose the best options for your individual situation.
